Terms and Conditions

1. Introduction

Welcome to BuiltRight Technologies Ltd ("Company", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of the BuiltRight Technologies platform, including all associated software applications, websites, and services (collectively, the "Platform").

BuiltRight Technologies Ltd is a company registered in England and Wales (Company Number: 16877690). Registered address: 128 City Road, London, EC1V 2NX.

By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.

2. Definitions

"Account" — the user account created to access our Platform.
"Applications" or "Apps" — the individual software modules available through the Platform.
"Content" — all data, text, documents, images, and other materials uploaded to or generated through the Platform.
"Subscription" — the paid access to one or more Applications.
"User" — any individual who accesses or uses the Platform.

3. Account Registration and Security

To access certain features of the Platform, you must create an Account. You agree to:

Provide accurate, current, and complete information during registration
Maintain and promptly update your Account information
Keep your login credentials confidential and secure
Notify us immediately of any unauthorised use of your Account
Accept responsibility for all activities that occur under your Account

We reserve the right to suspend or terminate Accounts that violate these Terms or that we reasonably believe to be fraudulent.

4. Subscriptions, Payments, and Billing

4.1 Free Trials

We may offer free trial periods for certain Applications. Trial periods are 14 days unless otherwise specified. At the end of a trial period, you must subscribe to continue using the Application.

4.2 Subscription Plans

Subscriptions are available on monthly or yearly billing cycles. Prices are displayed in GBP (£) and are exclusive of VAT unless otherwise stated. We reserve the right to modify pricing with 30 days' notice.

4.3 Payment Processing

Payments are processed through Stripe. By providing payment information, you authorise us to charge your payment method for all fees due. You are responsible for keeping your payment information current.

4.4 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled.

4.5 Refunds

Due to the digital nature of our services, refunds are generally not provided except as required by law or at our sole discretion. If you cancel within 14 days of a yearly subscription and have not extensively used the service, you may request a pro-rata refund.

5. Acceptable Use Policy

You agree NOT to use the Platform to:

Violate any applicable laws, regulations, or third-party rights
Upload or transmit viruses, malware, or other harmful code
Attempt to gain unauthorised access to any part of the Platform
Interfere with or disrupt the Platform's operation
Use automated systems to access the Platform without permission
Collect or harvest user data without consent
Impersonate any person or entity

Violation of this policy may result in immediate suspension or termination of your Account.

6. Intellectual Property Rights

6.1 Our Rights

The Platform, including all software, design, text, graphics, logos, and other content, is owned by BuiltRight Technologies Ltd and is protected by intellectual property laws.

6.2 Your Content

You retain ownership of Content you upload to the Platform. By uploading Content, you grant us a non-exclusive, worldwide licence to store, process, and display your Content solely for the purpose of providing our services.

6.3 AI-Generated Content

You are responsible for reviewing and customising AI-generated content to meet your specific requirements before use.

7–11. Service, Liability, Termination and Governing Law

Service Availability: We strive to maintain high availability of the Platform but do not guarantee uninterrupted access. Support is provided via email at support@builtright-technologies.co.uk during UK business hours.

Limitation of Liability: The Platform is provided "as is". Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim. Nothing limits our liability for death, personal injury caused by negligence, or fraud.

Termination: Either party may terminate these Terms by cancelling your subscription. Upon termination, you may export your data within 30 days.

Governing Law: These Terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11A. Client Finder and Direct Marketing

Client Finder helps you research businesses and draft outreach. You determine the recipients, purpose and content of any marketing campaign you run, and you must comply with UK GDPR, PECR and other applicable marketing laws.

Corporate B2B outreach may be undertaken where there is an appropriate lawful basis and all required transparency and opt-out controls are provided.
Cold electronic marketing to sole traders, ordinary partnerships and other individual subscribers must not be sent without valid consent or a legally valid soft opt-in.
Publicly available contact details do not automatically constitute consent.
Personal LinkedIn profiles and personal email accounts must not automatically be treated as corporate subscribers.
You must review AI-generated content before sending it.
Client Finder must not be used for harassment, indiscriminate spam, misleading communications or unlawful profiling.
You must respect objections, consent withdrawals and suppression records recorded on the platform.

BuiltRight remains responsible for the processing it determines, such as researching and matching businesses, and does not attempt to transfer that responsibility to customers. Personal data used by Client Finder is collected and processed with an appropriate lawful basis, which may be legitimate interests or consent depending on the type of contact and channel involved.
